NC Supreme Court returns gun owners rights.

The NC Supreme Court returned the gun rights to a fellow bird hunter Friday in a ruling that a 2004 law was unconstitutional and it punished him for the same crime twice over 20 years after the initial sentence. He was convicted of a felony drug offense as a young man in 1979. He served four months in prison and two years probation. NC law at the time restored his gun rights in 1987 after five years of no trouble. He was allowed to legally purchase and possess any firearm after 1987. He then returned to hunting and he and I hunted together until 2004 when the NC Legislature passed a law that a convicted felon (No matter what the charge) could not own or possess a firearm of any kind. They later changed the law to say a "Modern Firearm". He then went to the local sheriff to discuss his status as a felon but having his rights restored as stated above. The sheriff and the district attorney decided that he would be in violation of the law if he owned or possessed any firearms. He disposed of his firearms himself and filed a lawsuit against the State of NC to challenge the law. The NC Supreme Court ruled on Friday 8/28/09 that it was unconstitutional to punish him twice for the same crime. He can now return to hunting with us this fall as we have done for over 15 years until the travesty occured.
